1.Introduction and Acceptance of Terms
Welcome to Zwaya Jobs, an online platform designed to connect job seekers, skilled professionals, freelancers, employers, and businesses with employment, recruitment, freelance, and professional development opportunities.
These Terms & Conditions (“Terms”) govern your access to and use of the Zwaya Jobs website, accounts, features, content, and associated services (collectively, the “Platform”).
The Platform is operated by Zwaya Al Iraq for Online Services, Online Marketing, Advertising and Publicity LLC, a company registered in Baghdad, Iraq (“Zwaya Jobs,” “Zwaya,” “Company,” “we,” “us,” or “our”).
By creating an account, accessing the Platform, or using its services, you agree to comply with these Terms and the policies incorporated into them by reference.
If you do not agree with these Terms, you must not register for or use the Platform.
Where a separate agreement governs a particular paid service, subscription, enterprise arrangement, or other offering, that agreement will apply to the relevant service. In the event of a conflict, the more specific agreement will prevail to the extent of that conflict.

The availability of individual features may differ by account type, subscription, location, technical requirements, or stage of Platform development.
Unless Zwaya Jobs expressly agrees otherwise in writing, it acts as a technology platform facilitating connections between independent users. It does not become an employer, recruitment agency, employment guarantor, or party to an employment or freelance contract merely because users connect through the Platform.
Any service that Zwaya Jobs separately undertakes to provide as a recruitment intermediary, training provider, or contracting party will be governed by its applicable terms and legal obligations.
4.Eligibility and Account Registration
Users must have the legal capacity to accept these Terms and enter into binding agreements under applicable law.
Individuals must be at least 18 years old to register independently, unless Zwaya Jobs expressly permits another age under a specific service arrangement consistent with applicable law and appropriate safeguards.
By registering, you confirm that:
- The information you provide is accurate, current, and complete.
- You are legally entitled to use the Platform.
- You will maintain accurate account and profile information.
- You will not impersonate another person or organisation.
- You will not create accounts for fraudulent, misleading, or unlawful purposes.
- You will comply with these Terms and applicable laws.
An individual registering on behalf of an employer, company, or other organisation represents that they have authority to act for that organisation and accept these Terms on its behalf.
Zwaya Jobs may request reasonable verification of identity, professional credentials, business registration, or representative authority when necessary for security, compliance, or Platform integrity.
Account registration or verification does not constitute a guarantee of a user’s identity, qualifications, professional competence, financial standing, or reliability.
5.Account Security and Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for activities carried out through your account, except to the extent such activities result from circumstances for which Zwaya Jobs is legally responsible.
You must:
- Use appropriate measures to protect your login credentials.
- Notify Zwaya Jobs promptly of suspected unauthorised access.
- Avoid sharing personal account access with unauthorised individuals.
- Keep your account and contact information accurate.
- Use the Platform only for authorised purposes.
Employer accounts must ensure that access is granted only to representatives authorised to conduct recruitment or related business activities.
Zwaya Jobs may restrict account access, require additional verification, or take other proportionate security measures where reasonably necessary to protect users or the Platform.
Further requirements may be set out in the Account & Security Policy.
6.Job Seeker and Professional Accounts
Job seekers and professionals may create profiles, upload CVs, search for vacancies, submit applications, and use other available career-related features.
Users are responsible for ensuring that information contained in their profiles, CVs, qualifications, employment history, and applications is accurate and not materially misleading.
Users must not submit forged qualifications, false employment records, misleading credentials, or information belonging to another person without lawful authorisation.
6.1Searchable Profiles
Zwaya Jobs enables registered employers and recruiters to search professional profiles and CVs through the Platform.
By making a profile searchable, users acknowledge that professional information included in that profile may be accessed by registered employer accounts in accordance with available Platform functionality and privacy settings.
Depending on the features provided, employers may be able to view, contact, shortlist, or download candidate information.
Users should not include unnecessary sensitive personal information in searchable profiles or application documents.
Profile visibility and personal information processing are further addressed in the Privacy Policy.
6.2Job Applications
Submitting an application through Zwaya Jobs does not guarantee that an employer will review it, respond, invite the applicant to an interview, or offer employment.
Recruitment decisions are generally made independently by the relevant employer.
Users are responsible for assessing the suitability, legitimacy, and contractual conditions of employment opportunities before accepting an offer.
7.Employer and Recruiter Accounts
Employers and recruiters may use Zwaya Jobs to advertise vacancies, search for candidates, review applications, and communicate with prospective employees.
Employers must ensure that:
- Job advertisements describe genuine opportunities.
- Vacancy information is accurate, lawful, and not materially misleading.
- Recruitment activities comply with applicable employment and anti-discrimination laws.
- Advertised remuneration and working conditions are presented truthfully.
- Candidate information is accessed and used only for legitimate recruitment purposes.
- Applicants are not subjected to fraudulent recruitment practices or unlawful demands.
- The organisation and its representatives have authority to advertise and recruit.
Employers must not publish fictitious vacancies, misrepresent their identity, collect applicant information for unrelated purposes, or request unlawful payments from candidates.
Employers are independently responsible for employment offers, interviews, selection decisions, employment contracts, wages, benefits, workplace conditions, immigration requirements, and compliance with applicable labour laws.
Zwaya Jobs may review, reject, suspend, or remove job advertisements that reasonably appear fraudulent, unlawful, misleading, or inconsistent with Platform policies.
Publication of a vacancy does not constitute an endorsement or guarantee by Zwaya Jobs.
8.Recruitment Data and Candidate Confidentiality
Employers and recruiters must handle candidate information responsibly and use it only for legitimate recruitment-related purposes.
Candidate profiles, CVs, contact information, and application materials must not be:
- Sold or transferred to data brokers.
- Used for unrelated advertising or unsolicited marketing without a lawful basis.
- Published or disclosed without appropriate authorisation.
- Collected through automated extraction contrary to these Terms.
- Used for harassment, discrimination, identity theft, or fraudulent activity.
- Retained or processed in violation of applicable law.
Employers receiving candidate information may have independent privacy and data protection obligations.
Where an employer independently downloads, stores, or otherwise processes candidate information, that employer is responsible for its own lawful processing and retention.
Zwaya Jobs may investigate credible reports of misuse and take proportionate action, including restricting access to candidate search features or suspending an employer account.
9.Freelance Opportunities and Independent Services
Where freelance functionality is available, Zwaya Jobs may facilitate connections between freelancers, independent professionals, and clients seeking services.
Unless expressly agreed otherwise in writing, Zwaya Jobs is not a party to contracts independently entered into between freelancers and clients.
Freelancers and clients are responsible for agreeing on:
- Scope of work and deliverables.
- Project fees and payment arrangements.
- Deadlines and acceptance criteria.
- Intellectual property ownership.
- Confidentiality obligations.
- Applicable taxes and regulatory requirements.
- Dispute resolution arrangements.
The use of Zwaya Jobs does not, by itself, create an employment, agency, partnership, or joint venture relationship between Zwaya Jobs and a freelancer or client.
Zwaya Jobs does not guarantee project availability, client payment, freelancer performance, or successful completion of an independently contracted assignment.
If the Platform later provides escrow, milestone payments, managed projects, or other transaction services, additional service-specific terms will apply.
10.Courses and Professional Development Services
Zwaya Jobs may provide access to courses, training materials, educational resources, certifications, and professional development opportunities.
Such services may be provided directly by Zwaya Jobs or by independent third-party providers.
Course descriptions, eligibility requirements, fees, duration, assessment criteria, and certification conditions will be presented through the relevant offering where applicable.
Unless expressly stated otherwise, completion of a course or training programme does not guarantee employment, professional licensing, regulatory recognition, or acceptance by a particular employer.
Users are responsible for confirming whether a qualification or certificate meets their professional or regulatory requirements.
Third-party training providers remain responsible for their independently supplied content and services, subject to applicable agreements and law.
11.Fees, Subscriptions and Payments
Certain Platform services may be offered free of charge, while others may require payment.
Paid services may include employer subscriptions, recruitment tools, promoted listings, advertising, courses, or other features expressly identified as paid offerings.
The applicable price, billing period, service description, and material purchase conditions will be disclosed before the user confirms a purchase.
11.1Payment Processing
Payments are processed through third-party payment service providers.
Users may be required to accept the applicable payment provider’s terms and privacy notice.
Zwaya Jobs is responsible for its own contractual obligations relating to paid services, while payment providers remain responsible for services they independently supply.
11.2Subscriptions and Renewals
Where a subscription automatically renews, the renewal frequency, recurring charges, cancellation process, and any applicable notice requirements must be clearly disclosed before purchase.
Users will not be enrolled in an undisclosed recurring payment arrangement.
Subscription cancellation will take effect in accordance with the conditions disclosed at purchase and applicable law.
11.3Taxes and Charges
Applicable taxes, payment processing charges, or other mandatory fees will be disclosed as required by law.
Users remain responsible for taxes or statutory obligations arising from their independent employment, freelance, or business activities.
11.4Refunds
Refund eligibility, cancellation rights, and applicable procedures are governed by the Refund & Dispute Resolution Policy and any service-specific terms presented at purchase.
Nothing in these Terms excludes refund or cancellation rights that cannot lawfully be waived.
12.Acceptable Use and Prohibited Activities
Users must use Zwaya Jobs lawfully, responsibly, and in a manner that respects the rights of others.
The following activities are prohibited:
- Publishing fraudulent, fictitious, or materially misleading information.
- Impersonating individuals, employers, or organisations.
- Engaging in scams, phishing, identity theft, or deceptive recruitment.
- Harassing, threatening, exploiting, or unlawfully discriminating against others.
- Publishing unlawful, abusive, defamatory, or infringing content.
- Distributing malware or attempting unauthorised system access.
- Interfering with Platform security, functionality, or availability.
- Using automated scraping, harvesting, or extraction tools without written authorisation.
- Selling, redistributing, or commercially exploiting Platform data without permission.
- Sending unsolicited bulk messages or using the Platform for unauthorised advertising.
- Circumventing access restrictions, payment controls, or security measures.
- Misusing candidate information or confidential business information.
- Facilitating unlawful employment, trafficking, exploitation, or other illegal activities.
Additional conduct requirements are contained in the User Conduct Policy.
Zwaya Jobs may take proportionate action in response to suspected violations, including content removal, account restrictions, suspension, or referral to competent authorities where appropriate.
13.User Content and Intellectual Property
Users may submit information and materials such as CVs, profiles, job advertisements, portfolios, project descriptions, messages, and other content (“User Content”).
Users retain ownership of their User Content, subject to rights held by third parties.
By submitting User Content, users grant Zwaya Jobs a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, format, transmit, and otherwise process that content to the extent reasonably necessary to operate, provide, secure, and improve the Platform and deliver the services requested.
This licence does not transfer ownership of User Content to Zwaya Jobs.
Users represent that they have the necessary rights and permissions to submit their content and permit its use for the relevant Platform purposes.
Zwaya Jobs may remove or restrict content that infringes intellectual property rights, violates these Terms, or creates legitimate legal or security concerns.
The Zwaya Jobs name, logo, website design, software, original content, trademarks, and other proprietary materials remain the property of Zwaya Jobs or their respective rights holders.
Users receive a limited, revocable, non-exclusive, non-transferable right to access and use the Platform for its intended purposes, subject to these Terms.
Further provisions are set out in the Intellectual Property Policy.
14.Privacy and Personal Information
Zwaya Jobs processes personal information in accordance with its Privacy Policy and applicable legal requirements.
The Privacy Policy explains the categories of information collected, processing purposes, candidate visibility, employer access, data sharing, retention, international transfers, and available privacy rights.
Users should review the Privacy Policy before uploading CVs, creating professional profiles, or sharing personal information.
Employers and other recipients of candidate information are responsible for complying with applicable privacy and confidentiality obligations in their independent processing activities.
Acceptance of these Terms does not replace any separate consent required by applicable privacy law.
15.Verification, Trust and Platform Integrity
Zwaya Jobs may implement account verification, content review, fraud prevention, and other measures intended to improve Platform integrity.
However, the existence of an account, published vacancy, professional profile, verification indicator, or other Platform feature does not constitute an unconditional guarantee of identity, legitimacy, qualifications, employment conditions, or professional performance.
Users should independently evaluate employment offers, employers, freelance clients, and other opportunities before entering into binding arrangements.
Zwaya Jobs does not guarantee that all fraudulent or misleading activity can be detected or prevented.
Users are encouraged to report suspicious vacancies, fraudulent accounts, misuse of information, or other concerns through the Platform’s available reporting or support channels.
16.Availability and Changes to Services
Zwaya Jobs aims to provide a reliable and accessible Platform but does not guarantee uninterrupted or error-free availability.
Services may be temporarily unavailable due to maintenance, technical failures, security incidents, infrastructure problems, or circumstances beyond reasonable control.
We may modify, improve, replace, suspend, or discontinue features for legitimate operational, technical, commercial, security, or legal reasons.
Where changes materially affect paid services or existing contractual rights, we will provide appropriate notice and any remedy required by applicable law.
We will not use this provision to avoid obligations already owed to users under binding agreements.
17.Suspension and Termination
Zwaya Jobs may suspend, restrict, or terminate access where reasonably necessary because of:
- A material violation of these Terms or incorporated policies.
- Fraudulent, unlawful, or deceptive conduct.
- Misuse of candidate information.
- Security threats or unauthorised access.
- Repeated publication of prohibited content.
- Failure to pay applicable charges after appropriate notice.
- Legal or regulatory requirements.
- Other serious conduct that materially threatens users or Platform integrity.
Where appropriate and reasonably practicable, users may receive notice and an opportunity to address the issue.
Immediate action may be taken where necessary to prevent fraud, harm, unlawful activity, or serious security risks.
Users may request account closure through the available account management or support procedures.
Termination does not automatically extinguish outstanding payment obligations, accrued rights, lawful recordkeeping requirements, or provisions intended to survive termination.
Personal information will be handled in accordance with the Privacy Policy.
18.Third-Party Services and External Links
The Platform may contain links to employer websites, external application systems, payment providers, educational services, and other third-party resources.
Such services may be governed by independent terms, policies, and contractual arrangements.
Zwaya Jobs does not control the content or operation of independent third-party services and does not automatically endorse them merely by providing a link or integration.
Users should review relevant third-party terms before entering into transactions or sharing additional information.
Nothing in this section excludes responsibility that Zwaya Jobs cannot lawfully exclude.
19.Disclaimers and Limitations of Liability
Zwaya Jobs provides a digital platform for professional connections and related services.
Unless expressly agreed otherwise, we do not guarantee:
- That a job seeker will obtain employment.
- That an employer will identify or hire a suitable candidate.
- That a job advertisement will generate applications.
- That an employer or applicant will respond to communications.
- That a freelance project will be awarded, completed, or paid.
- That a course will lead to employment or professional accreditation.
- That all user-generated information will be accurate or complete.
- That Platform services will always be uninterrupted or free from technical errors.
To the extent permitted by applicable law, Zwaya Jobs is not responsible for independent employment decisions, workplace conditions, contractual disputes between users, or acts and omissions of third parties outside its reasonable control.
To the extent permitted by applicable law, Zwaya Jobs excludes liability for indirect or consequential losses arising from the use of the Platform where such exclusion is legally valid.
Any limitation of liability must be interpreted consistently with mandatory law, including applicable consumer protection requirements.
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, or any other liability that cannot lawfully be excluded or restricted.
Any monetary liability cap applicable to a specific paid service must be expressly stated in the relevant service agreement or purchase terms rather than assumed under these general Terms.
20.User Responsibility and Indemnification
Users are responsible for their own unlawful conduct, material misrepresentations, infringement of third-party rights, and breaches of these Terms.
To the extent permitted by applicable law, business users agree to indemnify Zwaya Jobs against reasonable third-party claims, losses, and expenses directly arising from their unlawful conduct, infringement of intellectual property rights, misuse of candidate information, or material breach of these Terms.
This obligation applies only to the extent the relevant loss is attributable to the business user’s conduct and does not extend to losses caused by Zwaya Jobs’ own unlawful acts, negligence, or breach of applicable obligations.
Individual consumers are not required to indemnify Zwaya Jobs beyond obligations enforceable under applicable law.
21.Governing Law and Dispute Resolution
These Terms are governed by the applicable laws of the Republic of Iraq, subject to mandatory legal protections that may apply to users in other jurisdictions.
Users are encouraged to contact Zwaya Jobs first to seek a practical resolution of complaints or disputes relating to Platform services.
Complaints may be submitted to info@zwayajobs.com.
Where a dispute cannot be resolved amicably, it may be submitted to the competent courts of Baghdad, Iraq, to the extent that such jurisdiction is legally permissible.
This provision does not deprive consumers or other protected users of mandatory jurisdictional rights or remedies available under applicable law.
Disputes arising independently between employers and job seekers, or between freelance clients and freelancers, are ordinarily the responsibility of the parties to those relationships unless Zwaya Jobs has expressly assumed a relevant contractual obligation.
Further information is provided in the Refund & Dispute Resolution Policy.
22.Changes to These Terms
Zwaya Jobs may update these Terms to reflect changes in Platform services, business operations, security requirements, or applicable law.
The current version will be published on the Platform with an updated effective or revision date.
Where changes materially affect existing users’ rights or obligations, appropriate advance notice will be provided where required by applicable law.
Material changes will not be applied retroactively in a manner that unlawfully removes accrued contractual rights.
Where renewed acceptance is legally necessary, Zwaya Jobs will request it through an appropriate mechanism.
23.General Provisions
- Entire Agreement:
- These Terms, together with applicable incorporated policies and service-specific agreements, govern the relevant relationship between Zwaya Jobs and its users.
- Severability:
- If any provision is held invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
- No Waiver:
- Failure to enforce a provision does not automatically constitute a waiver of the right to enforce it later.
- Assignment:
- Users may not transfer their accounts or contractual rights without prior authorisation. Zwaya Jobs may transfer relevant contractual rights and obligations as part of a lawful business reorganisation, subject to applicable law and the protection of users’ rights.
- Language:
- These Terms may be published in Arabic and English. Each version should convey the same substantive obligations. If a discrepancy arises, the interpretation required by applicable law will prevail unless the published service terms lawfully designate a controlling version.
- Relationship of Parties:
- Nothing in these Terms creates an employment, partnership, agency, or joint venture relationship between Zwaya Jobs and a user solely through use of the Platform.
