Zwaya Jobs

Intellectual Property Policy

Last updated: October 2026

1.Purpose and Commitment

Zwaya Jobs recognises that intellectual property rights are essential to protecting creativity, professional achievements, business identity, innovation, and the legitimate interests of individuals and organisations.

As a digital platform connecting job seekers, professionals, freelancers, employers, and businesses, Zwaya Jobs provides an environment in which users may create, publish, share, and access a wide range of professional and commercial materials.

This Intellectual Property Policy (“Policy”) establishes the principles governing the ownership, permitted use, protection, and responsible handling of intellectual property associated with the Zwaya Jobs platform.

Our objectives are to protect the Company's intellectual property, respect the rights of users and third parties, prevent unauthorised exploitation of protected materials, and provide appropriate procedures for addressing potential infringement.

This Policy forms part of the Zwaya Jobs Terms & Conditions and should be read alongside the Privacy Policy, User Conduct Policy, and other applicable platform policies.

2.Scope and Application

This Policy applies to all individuals and organisations accessing or using Zwaya Jobs, including:

  • Job seekers and employment applicants.
  • Professionals and freelancers.
  • Employers, recruiters, and business representatives.
  • Clients seeking freelance or professional services.
  • Training providers and course participants.
  • Commercial partners and other authorised users.

It applies to intellectual property associated with the Platform, including:

  • Company names, logos, trademarks, and branding.
  • Website design, software, databases, and technical components.
  • Original website content and promotional materials.
  • Professional profiles, CVs, and portfolios.
  • Job advertisements and recruitment materials.
  • Freelance project descriptions and deliverables.
  • Training materials and educational content.
  • Images, graphics, videos, text, and other creative works.
  • Other materials protected by applicable intellectual property laws.

This Policy applies to content published through the Platform and to relevant activities involving its access, reproduction, distribution, or use.

3.Ownership of Zwaya Jobs Intellectual Property

Unless expressly stated otherwise, intellectual property rights in the original materials created or lawfully owned by Zwaya Jobs remain the property of the Company or its respective licensors.

These materials may include:

  • The Zwaya Jobs name and associated branding.
  • Company logos, visual identities, and distinctive design elements.
  • Original website text, illustrations, graphics, and promotional content.
  • Proprietary software, source code, and technical systems.
  • Original website layouts, interface designs, and functional components.
  • Proprietary documentation and business materials.
  • Original compilations, databases, and other protected materials.

Access to the Platform does not transfer ownership of any intellectual property belonging to Zwaya Jobs or its licensors.

Users may not reproduce, distribute, modify, sell, license, or commercially exploit protected Company materials without appropriate authorisation, except where permitted by applicable law or these Terms.

The presence of third-party materials on the Platform does not imply that Zwaya Jobs owns those materials.

4.Permitted Use of the Platform

Subject to compliance with the Terms & Conditions, Zwaya Jobs grants users a limited, non-exclusive, non-transferable, revocable permission to access and use the Platform for its intended purposes.

Permitted activities may include:

  • Searching and applying for legitimate employment opportunities.
  • Creating and managing professional profiles.
  • Uploading CVs and professional portfolios.
  • Publishing authorised job advertisements.
  • Searching candidate information through authorised employer accounts.
  • Communicating regarding employment and freelance opportunities.
  • Accessing training or professional development resources.
  • Using other available Platform features in accordance with applicable terms.

This permission does not grant ownership of Platform software, branding, proprietary databases, or other protected Company materials.

Users must not exploit Platform content beyond the permissions expressly granted or otherwise available under applicable law.

5.Ownership of User-Generated Content

Users retain ownership of intellectual property rights they lawfully hold in content submitted to Zwaya Jobs.

User-generated content may include:

  • CVs and professional profiles.
  • Portfolios and work samples.
  • Job advertisements and company descriptions.
  • Project proposals and freelance materials.
  • Training resources and educational content.
  • Images, documents, and other uploaded materials.

Submitting content to Zwaya Jobs does not, by itself, transfer ownership of that content to the Company.

Users remain responsible for ensuring that they have the necessary rights, licences, permissions, or other lawful authority to submit and share their materials.

Where content includes intellectual property belonging to third parties, users must ensure that its submission and intended use are authorised or otherwise lawful.

Zwaya Jobs does not automatically acquire ownership of user-created materials merely because they are stored, displayed, or processed through the Platform.

6.Licence to Use Submitted Content

By submitting content to the Platform, users grant Zwaya Jobs a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, format, transmit, and otherwise process that content to the extent reasonably necessary to provide, operate, secure, and maintain the relevant services.

This licence may permit Zwaya Jobs to:

  • Display professional profiles to authorised users.
  • Make job advertisements available through the Platform.
  • Process CVs and application documents for recruitment-related functions.
  • Display portfolios or other materials according to applicable visibility settings.
  • Create technical copies necessary for storage, delivery, backup, and security.
  • Format content for compatibility with supported devices and interfaces.

The licence does not authorise Zwaya Jobs to sell user-owned creative works as independent commercial products or use private materials in unrelated advertising without an appropriate legal or contractual basis.

Users retain ownership of their content, subject to any rights held by third parties.

The licence ends when the relevant content is deleted or the account is closed, except to the extent continued processing is reasonably necessary for lawful retention, previously authorised disclosures, dispute resolution, or other purposes permitted by applicable law.

Content previously lawfully received by independent third parties may remain subject to their own legal rights and obligations.

7.CVs, Professional Profiles and Portfolios

CVs, professional profiles, portfolios, and work samples may contain original materials, personal information, and intellectual property belonging to users or third parties.

Users are responsible for ensuring that submitted materials are accurate and that they have the necessary authority to publish them.

Registered employers and recruiters may access searchable professional profiles and CVs for legitimate recruitment purposes.

Such access does not transfer ownership of candidate materials or grant unrestricted rights to reproduce, distribute, publish, or commercially exploit them.

Employers and recruiters must not:

  • Sell candidate CVs or portfolios.
  • Publish candidate materials without appropriate authorisation.
  • Use portfolios or work samples as their own commercial materials.
  • Reproduce original candidate work for unrelated business purposes without permission.
  • Distribute candidate materials to unauthorised third parties.
  • Remove ownership notices or falsely claim authorship of submitted work.

Access to candidate information remains subject to the Privacy Policy, User Conduct Policy, and applicable law.

8.Employer Content and Job Advertisements

Employers and recruiters retain the intellectual property rights they lawfully hold in their company descriptions, logos, recruitment materials, and job advertisements.

By publishing such materials on Zwaya Jobs, employers grant the Company the licence necessary to display, distribute, format, and promote the relevant content through the Platform and its authorised service channels.

Employers must ensure that they have the right to use any company branding, photographs, graphics, or other protected materials included in their advertisements.

Job advertisements must not unlawfully reproduce content belonging to unrelated employers or other third parties.

Employers must not use misleading branding or trademarks to impersonate another organisation.

Zwaya Jobs may remove or restrict advertisements where there are reasonable grounds to believe that they infringe intellectual property rights or violate Platform policies.

9.Freelance Work and Intellectual Property Ownership

Where Zwaya Jobs facilitates freelance opportunities, ownership of intellectual property arising from a project is determined by the applicable agreement between the freelancer and the client, together with relevant law.

Use of the Platform does not automatically transfer ownership of freelance deliverables to a client or to Zwaya Jobs.

Freelancers and clients are encouraged to agree in writing on:

  • Ownership of final deliverables.
  • Rights to preliminary concepts and working materials.
  • Transfer or licensing of intellectual property.
  • Payment conditions associated with ownership transfer.
  • Use of third-party materials.
  • Confidentiality requirements.
  • Rights to display completed work in professional portfolios.
  • Any limitations on future use or modification.

Unless expressly agreed otherwise, Zwaya Jobs is not a party to independent intellectual property arrangements between freelancers and clients.

The Company does not guarantee that a freelance deliverable is free from third-party intellectual property claims.

Disputes concerning ownership or licensing of independently contracted work are generally the responsibility of the contracting parties.

10.Training and Educational Materials

Training materials, courses, presentations, videos, documents, and educational resources made available through Zwaya Jobs may be protected by copyright or other intellectual property rights.

Ownership remains with Zwaya Jobs, the relevant training provider, or another lawful rights holder, as applicable.

Access to educational content does not automatically grant permission to reproduce, redistribute, resell, or commercially exploit that content.

Users may access and use training materials only in accordance with the permissions and conditions applicable to the relevant offering.

Training providers must ensure that they have appropriate rights to distribute educational materials through the Platform.

Additional licence terms may apply to specific courses, certificates, or educational products.

11.Trademarks, Logos and Brand Identity

The Zwaya Jobs name, logo, slogans, visual identity, and other distinctive brand elements may be protected under applicable trademark, copyright, or related laws.

Users must not use Zwaya Jobs branding in a manner that falsely suggests sponsorship, endorsement, affiliation, or authorisation.

Prohibited activities include:

  • Creating misleading websites or accounts using Zwaya Jobs branding.
  • Impersonating Company representatives.
  • Using Company trademarks to promote fraudulent services.
  • Modifying or reproducing logos for unauthorised commercial purposes.
  • Registering confusingly similar names or identifiers for deceptive purposes.

References to Zwaya Jobs for legitimate identification, commentary, or other legally permitted purposes are not prohibited solely because they mention the Company's name.

Use of third-party employer or business trademarks must also respect the rights of their respective owners.

Nothing in this Policy constitutes a claim that every brand element has been formally registered as a trademark.

12.Software, Technology and Database Rights

The Platform may contain proprietary software, technical systems, structured data, and other materials protected by applicable intellectual property or contractual rights.

Users must not, except where permitted by applicable law or expressly authorised:

  • Copy or distribute proprietary Platform software.
  • Attempt to obtain protected source code through unauthorised means.
  • Circumvent technical protection or access controls.
  • Reproduce substantial protected database content without authorisation.
  • Use automated tools to extract Platform information contrary to applicable terms.
  • Create unauthorised commercial services based on protected Platform materials.
  • Misuse technical documentation or proprietary information.

Nothing in this section restricts rights that cannot lawfully be excluded, including applicable statutory rights concerning software interoperability or permitted security research.

13.Third-Party Intellectual Property

Zwaya Jobs respects the intellectual property rights of third parties.

Users must not submit, reproduce, or distribute third-party materials without an appropriate legal basis.

Examples include:

  • Copyrighted photographs or illustrations.
  • Protected company logos.
  • Proprietary documents or training materials.
  • Software and digital assets.
  • Creative portfolios belonging to other professionals.
  • Confidential commercial content.

Where third-party content is lawfully displayed or linked through the Platform, ownership remains with the relevant rights holder.

Zwaya Jobs does not claim ownership of third-party materials merely because they appear on its website.

14.Artificial Intelligence and Automated Content

Where Zwaya Jobs introduces artificial intelligence or automated content-generation features, users must comply with applicable intellectual property laws and any service-specific terms.

Users remain responsible for reviewing content they submit or publish, including content created with the assistance of automated tools.

The use of artificial intelligence does not automatically establish ownership of generated materials or guarantee that such materials are free from third-party rights.

Ownership and permitted use of AI-assisted content depend on applicable law, the relevant service terms, and the circumstances of creation.

Processing user content with automated tools does not, by itself, transfer ownership of that content to Zwaya Jobs.

Any use of uploaded content to train artificial intelligence models beyond what is necessary to provide the requested service will require appropriate disclosures, permissions and legal grounds.

15.Copyright Infringement and Rights Complaints

Zwaya Jobs takes credible allegations of intellectual property infringement seriously.

Rights holders or authorised representatives who believe that material published through the Platform infringes their rights may submit a complaint to:

A complaint should, where reasonably possible, include:

  • The complainant's name and contact information.
  • Identification of the protected work or intellectual property.
  • The location or description of the allegedly infringing material.
  • An explanation of the rights claimed and the alleged infringement.
  • Evidence of ownership or authority to act for the rights holder.
  • Any additional information reasonably necessary to assess the complaint.

Zwaya Jobs may request clarification or supporting documentation before taking action.

The submission of a complaint does not automatically establish infringement or require immediate removal without appropriate assessment, except where applicable law requires otherwise.

16.Review and Removal of Allegedly Infringing Content

Upon receiving a credible intellectual property complaint, Zwaya Jobs may review the available information and take appropriate measures.

Depending on the circumstances, these may include:

  • Requesting additional evidence.
  • Contacting the user responsible for the content.
  • Temporarily restricting access to disputed material.
  • Removing content where infringement is reasonably established or removal is legally required.
  • Requiring corrective action.
  • Restricting or suspending accounts involved in serious or repeated violations.
  • Complying with lawful orders issued by competent authorities.

Actions will be determined according to the available evidence, applicable law, the nature of the alleged infringement, and the rights of affected parties.

Zwaya Jobs may act promptly where necessary to prevent serious harm or comply with legal obligations.

17.Disputed Claims and Requests for Reconsideration

Users whose content has been removed or restricted because of an intellectual property complaint may request reconsideration.

A request should identify the affected material and explain why the user believes the content was lawfully submitted or used.

Supporting information may include evidence of ownership, a valid licence, authorisation from the rights holder, or another relevant legal basis.

Zwaya Jobs may review the information and determine whether to maintain, modify, or reverse the restriction.

Where a dispute concerns competing ownership claims or complex legal rights, Zwaya Jobs may require the parties to resolve the matter through appropriate legal channels.

The Company is not required to determine ownership disputes that fall outside its role as a digital platform.

18.Repeated or Serious Infringement

Zwaya Jobs may take additional action against users who repeatedly or seriously infringe intellectual property rights.

Measures may include warnings, content restrictions, suspension of particular features, or termination of account access.

Relevant factors may include:

  • The nature and seriousness of the infringement.
  • The available evidence.
  • Whether the conduct was deliberate or repeated.
  • The user's response to previous notices.
  • The risk of continued harm.
  • Applicable legal requirements.

Enforcement measures will be applied in accordance with the Terms & Conditions and relevant Platform policies.

19.Confidentiality and Protection of Proprietary Information

Users must respect confidential information obtained through professional or commercial interactions on Zwaya Jobs.

Confidential materials may include unpublished business documents, project specifications, proprietary designs, technical information, recruitment materials, and other information disclosed under an obligation of confidentiality.

Users must not disclose, reproduce, or exploit such information without appropriate authorisation.

Freelancers and clients are encouraged to establish clear confidentiality obligations where projects involve sensitive or proprietary information.

Zwaya Jobs' handling of personal information remains subject to the Privacy Policy.

This Policy does not prevent disclosures required by applicable law or otherwise legally protected.

20.Intellectual Property Disputes Between Users

Zwaya Jobs may facilitate connections between independent parties but does not automatically become a party to their intellectual property arrangements.

Disputes between employers, candidates, freelancers, clients, or training providers may concern:

  • Ownership of creative work.
  • Portfolio permissions.
  • Use of confidential materials.
  • Licensing conditions.
  • Copyright infringement.
  • Payment-related ownership transfers.
  • Unauthorised reproduction of documents or designs.

The relevant parties are ordinarily responsible for resolving these disputes according to their agreements and applicable law.

Zwaya Jobs may take proportionate Platform-level action where a dispute involves a credible violation of its policies.

Such action does not constitute a final legal determination of intellectual property ownership.

21.Applicable Law and Legal Rights

This Policy is governed by the applicable laws of the Republic of Iraq, subject to mandatory legal protections that may apply in other jurisdictions.

Relevant intellectual property rights may also be affected by the laws of the jurisdiction in which a work was created, protected, published, or allegedly infringed.

Nothing in this Policy transfers rights that cannot lawfully be transferred or restricts exceptions, limitations, or other protections established by mandatory law.

Where additional legal obligations apply to Zwaya Jobs' activities in other jurisdictions, the Company will address those obligations as required.

Intellectual property disputes requiring a binding legal determination may be referred to competent courts or authorities in accordance with applicable law.

22.Policy Review and Updates

Zwaya Jobs may review and update this Intellectual Property Policy to reflect changes in Platform functionality, user services, technology, applicable law, or relevant intellectual property practices.

The latest version will be published on the Zwaya Jobs website with its effective or revision date.

Where changes materially affect users' rights or obligations, appropriate notice will be provided where required by applicable law.

Changes will not retroactively remove intellectual property rights already acquired by users or third parties under applicable law.
